1. Developers M/S Huma Developer has unauthorised constructed shops at Gr. flr of the residential bldg. Prathamesh Apt. Whereas OC is granted for residential Purposes. As per approved plan while granting OC there are 12 flats (3 on each floor) but actually Gr. floor consists of 1 flat and 4 shops which is clear violation of BMC rules. Complaint lodged with BMC authorities and sent several reminders but no action has been taken so far.
2. Developers have also encroached adjoining PG land and constructed a hut over it and also surrounded three green trees with boundary. Only top portions of the tree can be seen. They have made unauthorised access in the boundary wall of the building creating nuisance for the residents of the building. As per the approved plan there is no access point in the boundary wall. Complaints lodged to BMC but no action has been taken. Even there is possibility that the trees may be cut by the encroachers.

Your Suggestion for a Solution |
1. BMC /Police should taken strict action against Developer for constructing unauthorised shops at ground floor and he may be asked to restore the building as per approved plan at the time of granting OC.
2. The unauthorised encroached hut on the PG land should be demolished, trees are freed and illegal entry point in the boundary wall may be closed. Developer should be properly penalised for his misdeed.

Response of Authority |
Only response we have got about illegal shops from A.E. (Bldg & Works) H/E ward that notice under MRTP Act has been issued to the Shop about one and half year back. Since then 2 more shops has been opened but BMC is not taking any action. Also when verbal enquiry is made we get cold response from BMC officials. |
