30.09.2008 To, The Municipal Commissioner, BrihanMumbai Mahanagar Palika (BMC) Head Office, Old Opp V.T Station, V.T, Mumbai. Kind Attn: Mr Jayraj Phatak Sub: Demolition & Removal of Unauthorized Hutments Constructed over the Foot Path underneath of which is a Storm water Drain along the Service Road running Parallel to Eastern Express Highway and abutting our Krishnalaya Co-op Hsg Soc Ltd on Postal Colony Road, Chembur, Mumbai- 400 071. Dear Sir, As regards subject matter, we wish to state that we have written innumerable letters to the concerned officers of the 'M' Ward office as well as apprised them several times by meeting in person for the Demolition & Removal of Unauthorized Slums constructed adjoining our Society on the Footpath of the Service Road running parallel to the Eastern Express Highway and underneath of Footpath is a Storm water Drain of BMC but all our efforts are in vein. As and when we have approached and expressed our grievances to the offices of BMC 'M'Ward for Demolition and Removal of the same, we found their approach to be Pro-Slum Dwellers and purely against taking any action against them. Our complaints and grievances were always over looked by the officers of BMC on one or the other pretext that the said area over which the footpath is constructed does not fall under the jurisdiction of BMC and falls under MMRDA's jurisdiction. On approaching MMRDA in this regard, we were informed that MMRDA's Right of way is 60 Metres from the Centre of the Eastern Express Highway and the said footpath over which the Slums have been constructed falls beyond the said distance of 60 metres and is not in the jurisdiction of MMRDA and thus falls only in the jurisdiction of BMC. We have confirmed this fact by physically measuring the said distance on site along with MMRDA's Representative. In view of all this we very well know the fact that the said area over which the Slums have been constructed falls under the jurisdiction of BMC and not within the purview of MMRDA. We have even apprised about this situation a several times to our Local Corporator, Mr Prakash Phaterphekar The Slum dwellers are a severe menace to the Society and to all the residents staying in the Vicinity. The Slum Dwellers have become a nuisance to our Society as such they have damaged and broken our Compound Wall while constructing their hutments. Those slum dwellers even have trespassed into our Society a couple of times with the intention of robbery. The Slum Dwellers have spoilt the entire face of the vicinity by dumping garbage, throwing dirt and using the service road and footpath for attending natures call too. This is a Black Spot on BMC's Slogan of Clean-N-Green Mumbai These Slums are constructed very recently and almost one and half years ago. We have also understood that those Slum Dwellers were already rehabilitated by BMC & MMRDA and have been given Flats in Mankhurd under the Scheme of Rehabilitation of Project Affected people despite which they have re-migrated over here and re-constructed the Slums over the footpath. We apprehend that there is a strong nexus behind this Slum Dwellers who are creating such nuisance. We have also expressed our willingness and readiness to beautify and maintain the said foot-path in the event the Slums are removed once for all and the said footpath is handed over to our Society purely for maintenance purpose. The copies of series of letters written to BMC along with the Photographs of actual site situation is also enclosed herewith. In view of all the above we request you to solicit your kind intervention in this matter and instruct your officers to take stringent steps and actions in this regard and to do the needful at the earliest. We look forward for immediate action in this regard. We request your Immediate Attention to resolve this problem. A Stringent and immediate action should be taken for Removal of Un-Authorised Slums constructed over the Foot Path of the Service Road during the last 1 & 1/2 years underneath of which is a Storm Water Drain of BMC. |
