Dear Mr Roy,
Subject: Violation of Supreme Court Order on Noise Pollution by the law enforcement authority
I was distressed to note that Noise Rules and Supreme Court Orders were violated both for decibel levels and time limits at a Police function on 18th December at which you were personally present.
Many persons who were restrained from breaking the law with respect to Noise Pollution after the Supreme Court passed it's recent Order would be aggrieved by the unfairness of this and future effectiveness of the Police would certainly be affected. It would be appropriate and would help to restore public confidence in the law enforcement mechanism to impose maximum penalties under the Environment Protection Act, (which amount to Rs 1 lakh and 5 years jail term) to the organizer of the function. It is important for the public to perceive that such breaches, particularly when perpetrated by the law enforcement authority against the law and against the directions of a Supreme Court ruling will not be tolerated.
I request that, in the interest of public accountability, the process by which a case was registered against the offenders and fines imposed be made known to us.
I also request that maximum fines be imposed as prescribed under the provisions of the Environment Protection Act for breach of Noise Rules on 18th December.
