Noise Pollution due to construction activity at Lonavla

A: Details of the problem
1.Problem: Noise Pollution due to construction activity at Lonavla
2. Period: 2007 - January
3. Details: For the past 3 years, a builder in Lonavla who owns a rock-breaker has been disturbing the peace of the area with no regard to the law regarding noise pollution. I have tried to file a complaint with the Police but they refused to take my complaint saying that construction activity does not qualify.
 
4. Additional information: Nil
5. Steps taken till now:
 I have filed 1 Police Complaint based on which the builder was told to stop work.
 
6. Result:
 The builder got an undertaking from the District Collector of Wadhwan permitting excavation work. I tried to file a 2nd complaint with the Police, but they have refused to take my complaint now.
 
7. Help needed now:
 Police say that construction activity is not noise, only noise from loud speaker comes under the law. I would like to file a case against the builder as well as the local police for breaking the law.
 
8. Will pay fees for help / professional advice:

B: My Suggestions
1. For Commercial organisations: Individuals must stand up and fight against those who break the law, rather than look away and take the line of least resistance, as the fabric of our society and country is gradually deteriorating.
 
2. For NGOs: Please set up Help Desks for advice on how ordinary citizens can take action against law-breakers and government when it fails to ensure the rights of citizens.
 
3. For Government: Ensure that the Police helps to maintain the law, rather than abet the law-breakers. Enable ordinary citizens to easily complain against officers who work against citizens.
 
4. For others in a similar situation: Complain and take a stand when the law is broken.
