CO-OPERATION MEANS CORRUPTION

HERE I HAVE TO PLACE SOME FACT BEFORE YOU FOR YOUR CONSIDERATION:

1.                  Revenue Dept. consists of Income Tax, Sales Tax, Excise, Custom and other Direct and Indirect Taxes Department Top Grade Staff are selected and appointed from  having passed IRS exam and others semi administrative staffs also have to appear and pass Dept.  exams and after word they are selected.

2.                  Police Dept. Top Grade Staff are selected and appointed from  having passed IPS exam and others staffs also have to appear and pass Dept.  training exams and after word they are selected.

3.                  Administrative Dept. consist of Company Law Board and other State management Top Grade Staff are selected and appointed from  having passed IAS exams.

The Corruption in above Departments does not effect all the persons.  Corruption in these departments are effect only to Business Class and Industrialists.  Please note that only to Business Class and Industrialists are responsible for the Corruption in these Departments and not the general public because they are not related any way.

BUT THERE IS ONE ADMINISTRATIVE DEPARTMENT WHICH EFFECT THE GENERAL PUBLIC  WHERE EVEN QUASI JUDICIAL AUTHORITIES ARE ALSO CORRUPT.

The Department is CO-OPERATIVE :-

1.                   In all over India most of the public resides and/or doing business  in Co-operative Society formed by number of persons after purchasing the Flat / Row House / Shops and/or Industrial Units.

2.                  In Maharashtra the Co-operative Act has come in force since 1960.  Under the same Act any group of persons can form a  Co-operative Society for the purpose of Residence and/or Business.

3.                  The CORRUPTION  starts in this DEPARTMENT starts since starting only.

4.                  If the group of persons have to apply for formation of Society they have to bribe through agents to the concern staff of the Department, otherwise even the Department may not accept the application also.  If they accept the application under any force than the same will not be considered because of they are BLIND, Dumb and DEAF .

5.                  Under this Act one Department is HOUSING for which the Maharashtra Government through COMMISSIONER OF CO-OPERATIVE SOCIETIES AND REGISTRAR OF MAHARASHTRA STATE  having his office at Pune have framed MODEL BYE-LAWS in the year 2001 under a Committee formed and same were approved by than Principal Secretary Co-operative and Marketing Department, Maharashtra State.

“As per Bye-Law No. 68 and 69 levy of SERVICE CHARGES equally divided by number of flats/units etc. which consist of Salaries of the Office Staff, Lift Man, Watchmen, Malis and other employees of the Society, Printing, Stationery, Postage, Travelling Allowance, Audit Fees, Retainer fees, Legal charges, Common Electricity Charges,  and other expenses.”

6.                  To clarify I approached to Advocate D. S. Vader Chairman of the Federation for opinion on payment of fees but he refused to give opinion on the ground that I am the member of one of Society.

The several societies are  charging the service charges to their members on area wise instead of unit wise.

If member does not pay the said maintenance the society files their claim under sec. 101 of MCS Act and gets Recovery Certificate.  Under sec 101 the Dy. Registrar gives Recovery Certificate to the Society without hearing the Member though member shows his willingness to FURNISH SECURITY  under sub-section 4 of sec. 101 of MCS Act.

Even the Department does not allow the member to Appeal though member shows his willingness to FURNISH SECURITY  under sub-section 4 of sec. 101 of MCS Act.

These all are because of whole department is CORRUPTED and mostly favors the societies only.

IN THE CIRCUMSTANCES I DESIRE TO FILE A PETITION FOR PUBLIC INTEREST LITIGATION ON THE SUBJECT FOR WHICH I REQUIRE ONLY MORAL SUPPORT OF ALL OF YOU.
